Location of Sale

Title to, and ownership of, all wine passes from seller to buyer in the State of California, and buyer takes all responsibility for shipping the wine from California to his or her home state. By placing an order, buyer authorizes seller to act on buyer’s behalf in arranging for transportation of the wine at the buyer’s direction. Alternatively, buyer may choose to pick up the wine at seller’s location or make independent shipping arrangements. Seller makes no representation as to the legal rights of anyone to ship or import any wines, alcoholic beverages or other goods into any state. The buyer warrants that he or she is solely responsible for the shipment of wine and other goods purchased and for determining the legality and the tax/duty consequences of having the wine and other goods shipped to the applicable destination.

Delivery and Shipment

1. If you request the shipment of any order placed with Delicious Wines, you authorize Delicious Wines to engage a common carrier to deliver your order on your behalf. By arranging for transportation via common carrier, Delicious Wines is providing a service to, and acting on behalf of, you. This service is provided free of charge, but YOU ARE SOLELY RESPONSIBLE FOR DETERMINING THE MANNER IN WHICH ALCOHOLIC BEVERAGES MAY LAWFULLY BE BROUGHT INTO YOUR JURISDICTION. By utilizing this service, you represent that you are acting in a fashion compliant with your local and state laws regarding the purchase, transportation and delivery of alcohol. You represent that you are 21 years of age or older and that you have obtained any required permission, paid any required fees, are working through properly licensed intermediaries where required, are legally entitled to take possession of wine and are legally entitled to take quantities ordered. You are solely responsible for all applicable excise, use and sales taxes due to your jurisdiction related to the purchase of any taxable goods. DELICIOUS WINES MAKES NO REPRESENTATION REGARDING THE LEGAL RIGHT OF ANYONE TO SHIP OR IMPORT ALCOHOLIC BEVERAGES INTO ANY JURISDICTION.
2. When acting on your behalf to arrange transportation via common carrier, wherever possible, Delicious Wines will endeavor to ensure shipments do not spend the weekend with a non-temperature controlled common carrier. You acknowledge that: (i) shipment of your order may be delayed in order to accomplish this, and (ii) Delicious Wines does not, and cannot, guarantee that your order will not spend the weekend with a common carrier. In all instances, Delicious Wines reserves the right to delay release of your order due to extreme weather conditions. If you require expedited service, please contact us.
3. When acting on your behalf to arrange transportation via common carrier to a hotel or other third party destination, Delicious Wines (i) will not be responsible for any loss or damage to any package or its contents once signed for, either directly or indirectly, at the hotel or other third party destination; (ii) will not accept returns on orders sent to hotels or third party destinations; and (iii) will not bear any responsibility for communicating with your hotel or third party destination regarding receipt and proper storage conditions upon arrival.
4. Delicious Wines may from time to time and at its sole discretion, offer reduced shipping rates within the State of California via common carrier on certain qualifying orders as permitted by law. Any such offer may change at any time, with or without notice. By arranging for transportation via common carrier, Delicious Wines is providing a service to, and acting on behalf of, you, as further described in Section 3(a) above. Any offer for an order featuring a reduced shipping rate is an an offer for the order including the cost of shipping in the price of the relevant items.
5. HOLDING ORDERS. At your request, Delicious Wines will hold your order for up to thirty (30) days after all items on your order are ready for shipment (the “Ready Date”) or until the next seasonally moderate shipping window. This service is provided to you at no charge as a courtesy. Orders so held remain your property, and are not the property of Delicious Wines. If you do not choose to ship your order within 30 days of the Ready Date, or during the next seasonally moderate shipping window, you will be charged $10 per case, per month, for storage until shipment of your order. Delicious Wines reserves the right to charge additional fees for the storage of especially large orders over long periods of time.
